Noti Terms of Service

1. Who you are agreeing with
Noti is operated by F.A Lemon & P Lemon, a partnership trading as Noti, ABN 42 966 457 260, Sydney, New South Wales, Australia ("Noti", "we", "us"). You can contact us at hello@noti.com.au.
These terms apply when you create an account or a business on app.noti.au, or use a Noti booking page, customer page or link. If you accept them for a business, you confirm you are authorised to bind that business.
2. What Noti is, and is not
Noti is software for running a business: customers, bookings, jobs, quotes, invoices, payments, messages, stock, orders and reporting.
- Noti is not an accountant, bookkeeper, tax agent or lawyer. It calculates GST from the tax treatments you choose and the prices you enter. Those figures are a record of what you told it, not advice. You are responsible for what you lodge.
- Noti is not a bank and does not hold your money. Card payments are processed by Stripe (section 8).
- Noti does not use artificial intelligence to read, write or decide anything in your business. If that changes, we will update these terms and our Privacy Policy first.
3. Australia only
Noti is offered to businesses operating in Australia, in Australian dollars, with Australian GST.
4. Your account, your team and your devices
- You are responsible for everything done in your business on Noti, including by people you invite and on devices you pair.
- Roles. Noti has owner, manager, office, staff, accounts and read-only roles. Only an owner can make, change or remove an owner. A manager can manage people below manager. A business always keeps at least one owner; to hand a business on, an owner makes somebody else an owner and can then step down.
- Invites are for the email address they were sent to, work once, and expire after 14 days.
- Shared devices are unlocked with a personal PIN, and what is done on one is recorded against whoever unlocked it. Remove people and devices when somebody leaves — we cannot know that they have gone.
- Keep your sign-in safe. Tell us straight away if you think your account has been used by somebody else.
5. Plans, modules and prices
Prices are in Australian dollars and include GST.

- Texts. Base includes 100 texts a month, counted in message parts, sent or received. Beyond that, texts are 10c each including GST. Sign-in codes are never charged to you.
- Availability. Paid plans, modules and card payments are opened to businesses progressively. Until they are available to your business, you use Noti Free, and anything we have agreed with you in writing.
- Coming later. Some features are shown as coming later — including Team, Insights & Automation, and Noti Phone (a business phone number with calls and voicemail). They cannot be bought or switched on, and each will come with its own terms when it is offered.
- Arrangements. We may agree a different price, a waiver or an early-access arrangement with a particular business in writing. It applies for the period we agree.
- Price changes. We will tell you at least 30 days before a price you pay goes up, by email and in the app. You can move to Free or close your business before it takes effect.
6. Paying Noti
- Plans and modules are billed monthly in advance, on the same day each month, to a card you give us. The card is held by Stripe; Noti keeps only a label such as "Visa ending 4242".
- Moving to Base. Moving from Free to Base is charged straight away, and Base starts when that payment is confirmed. If the card is declined, or your bank asks you to approve the payment, you stay on Free and nothing is owed. If the payment cannot be confirmed straight away, you stay on Free until it is. We check with our card processor before trying a payment again, so the same bill is not charged twice.
- If a payment fails, we email the owner and try again: one day after the first failure, three days after the second and seven days after the third. If your bank needs you to approve the payment, we ask you to do that rather than retrying a payment that cannot succeed without you.
- Grace, then Free. If an amount is still unpaid, your paid plan keeps working for 30 days from the first failure while you sort it out. After that, your business moves to the Free plan and we stop billing you for Base and the products you bought. Your data is kept and you can export all of it at any time, but what Free does not include — jobs, invoicing and the products you bought — is unavailable until you return to Base. The amount you owe stays owed, and you can pay it at any time.
- Returning to Base. You can return to Base whenever you choose, once anything you owe is paid. Before we take payment we show you the price of Base and of the products you had, which come back with it once the payment is confirmed. Paying an amount you owe does not by itself restart Base.
- Cancelling Base keeps it available until the end of the period you have already paid for; then your business moves to Free. There is no partial refund for the rest of that period. Your data is kept, but what Free does not include is unavailable until you return to Base; products you bought can be added again then.
- Refunds. Noti's fees are not refunded, except where the Australian Consumer Law requires it or where we charged you in error.
- Tax invoices for what you pay Noti are issued by Noti Australia with our ABN and show GST.
7. Card processing on your customers' payments
The rates in section 5 are what Noti charges on each card payment your customers make through Noti. They are shown in the app before you take a payment and on every payment afterwards. When you refund a customer, Noti's processing charge on the original payment is not returned.
8. Taking card payments
- Card payments are processed by Stripe. To take them, you open a Stripe account through Noti and accept Stripe's Connected Account Agreement, which is between you and Stripe.
- You are the merchant. Your business's name appears on your customer's statement, and money settles from Stripe to the bank account you nominate. Noti never holds it.
- Stripe will ask for identity and business details. That is a legal requirement on Stripe, and card payments cannot be switched on without it.
- Money can be held by Stripe — for unusual amounts, disputes or verification. We will tell you what we know about why, and what is needed.
- Disputes and chargebacks are yours. If a customer disputes a payment and wins, the amount and any dispute fee come out of your Stripe balance.
- Noti does not see or store your customers' card numbers.
9. Messages to your customers
- You are the sender of the messages Noti sends for your business, and you must have the right to send them, including under the Spam Act 2003. Noti records consent, honours opt-outs, and refuses to send where consent has been withdrawn — but having consent in the first place is your responsibility.
- Noti separates transactional messages (a booking confirmation, a reminder, an invoice) from marketing. Marketing is not sent unless the customer has agreed to receive it.
- Texts come from Noti's shared number, and emails arrive as "Your business (via Noti)". A customer who replies STOP to Noti's number stops texts from every business on Noti, because they all come from that number. Replying START restores them.
- Replies your customers send come back into your business in Noti.
10. Your booking page and customer links
- Your booking page, and the links Noti sends your customers (quotes, invoices, receipts, confirmations, their own customer page), show your business and act on your behalf.
- Noti limits abuse of public pages. A booking page refuses bookings when more arrive than a real page receives — from one address, from new contacts in an hour or a day, or from one contact in a day — and tells you it did. Genuine customers are asked to contact you directly. We may change these limits to protect you, your customers and the service.
- Customers can add up to five photos (10 MB each) to their own booking. Only your business can see them.
- You can revoke a link from the app, and it then stops working.
11. Your data is yours
- You own your business's data. You give Noti permission to store, process, display and transmit it only to provide Noti to you, as described in our Privacy Policy.
- You can export all of it at any time, on every plan including Free, as spreadsheet files: customers, work, documents, payments, products, stock, messages, history and payment records. Export keeps working if a plan lapses, and we will never charge for it.
- We do not sell your data, show you advertising, or use your business's contents to train artificial-intelligence models.
Most of what is in Noti is about other people — your customers. You collected it and you are responsible for it under the Privacy Act 1988 where that Act applies to you. Noti handles it on your behalf and on your instructions.
- Tell your customers how you handle their information. Noti's booking page shows a short collection notice naming your business and linking our Privacy Policy; it does not replace your own obligations.
- Use roles and permissions to decide who in your business sees what. Noti keeps a record of who opened each customer, job and document; owners and managers can read it.
- Do not put health information or other sensitive information about your customers into Noti. It is not designed or offered for health services.
- If a customer asks you for their information, you can export it, correct it, archive their record or merge duplicates in the app, and we will help you.
13. What you must not do
You must not use Noti to break the law; message people who have not agreed or who have opted out; take payment for anything you are not entitled to sell; try to reach another business's data or test Noti's security without our written permission; script or flood booking pages or links; store health or other sensitive information; or resell Noti as your own.
14. What we will not do
- Put your own data behind a paywall, or charge you to leave.
- Make help conditional on your plan when money is stuck, an account is compromised, or a payment has gone wrong.
- Change something in a way that breaks how you work without telling you first, unless security or the law requires it.
15. The service
Noti is a service that changes. We fix what is broken, add what is missing, and sometimes retire something. Features marked coming later are plans, not promises. We aim to keep Noti available all the time, but we cannot promise it will never be interrupted or never contain an error.
16. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are allowed to limit our liability for failing to comply with a consumer guarantee, our liability is limited to supplying the service again, or paying for it to be supplied again.
To the extent the law allows, our total liability for any claim relating to Noti is limited to the fees you paid Noti in the 12 months before the claim arose, and we are not liable for indirect or consequential loss, for a tax position you took, for a message you chose to send, or for a decision you made using a figure Noti showed you.
17. Closing your business on Noti
- An owner can close the business from Settings at any time, without calling anybody. Export anything you want to keep first.
- Closing starts a 30-day recovery period. During it the business stops operating normally, and an owner can reopen it.
- After the recovery period, the business cannot be reopened. Its operational and customer information is then deleted, or irreversibly anonymised, as our Privacy Policy describes. We keep only the records we are required by law to keep, such as our own tax records of what you paid Noti, and only for as long as the law requires. Backups held by our hosting provider age out on their normal schedule and are not restored except to recover the service.
- Your customers' links stop working when the information behind them is deleted.
18. Suspension and ending this agreement
- By you: close your business at any time (section 17).
- By us, for convenience: with at least 30 days' notice by email. If we do, we will refund what you have paid for time you will not get.
- By us, straight away: we may limit, suspend or end your use of Noti immediately, or on shorter notice, for serious misuse, illegal use, a security risk to Noti, you or others. Where we can, we will contact you first.
- Non-payment: if a payment is not made, your business moves to Free as section 6 describes.
19. Changes to these terms
We will tell you at least 14 days before these terms change in a way that matters, by email and in the app, unless a change is legally required or urgently needed for security, in which case we will tell you as soon as we can. Using Noti after a change takes effect is agreement to the new version. Every version is kept and dated.
20. Law
These terms are governed by the law of New South Wales, Australia, and you and we submit to the courts of New South Wales.
21. Our other services
noti.com.au is Noti Custom, our consultancy, under its own terms and privacy policy. Neeve is a separate health app with its own policy. Neither is covered by these terms.
